UKVIA Launches Framework for Vape Licensing Scheme

The UK Vaping Industry Association (UKVIA) launches a “framework” for the vape licensing scheme. It is responding to the UK’s ban on disposable vapes and measures to restrict the category.

UKVIA launched the framework for the industry at a parliamentary event on February 21.

These measures include:

  • Limiting e-liquid flavors that are more attractive to children;
  • Adopting simpler packaging;
  • Changing the way retailers display vape products.
  • The vape products will be moved out of children’s sight and away from their favorite products (such as candy).

The scheme is funded by retail charges. In the penalty rules, once more than four violations are found, the corresponding penalty system will be activated.

UKVIA estimates that this scheme will generate over £50 million per year for enhancing enforcement activities. The scheme will be implemented at local government level. And the central government level will manage it. It provides a “joint national enforcement manual” to the local trading standards teams.

Under the new scheme, “inappropriate” businesses will not be able to obtain a license. Such as takeaways, hairdressers and taxi companies. While pubs and clubs will be allowed to apply for a license.

To obtain a license, retailers must meet and maintain a strict set of “eligibility standards” covering key areas. For example, youth prevention, quality control and product standards, marketing. And advertising practices, and environmental and recycling obligations.

The four-penalty regime will see retailers who breach the rules four times being fined up to £10,000. Also, there is a risk of losing their license. Besides, unapproved sellers will automatically face a £10,000 fine. What’s more, the scheme also includes test purchases and stock checks every 6 months.
