Texas Warns Retailer Not To Sell Vapes That Appeal to Minors

Vape sale in Texas gets more strict next year. Texas State Comptroller Glenn Hegar recently reminds the vape retailers not sell vapes that appeal to minors.

Starting from January 1, 2024, advertising, selling or sale certain vape devices designed to attract minors will constitute a crime in Texas.

“It is illegal to sale vapes to minors — these products are dangerous and most contain nicotine, heavy metals and cancer-causing materials — yet these products are intentionally designed to attract minors,” Hegar says.

What’s more, he also emphasizes that Texas has taken action to address this deceptive marketing practice. And he is grateful for the partnership of retailers across the state to assist protect the most precious resource: the children.

The House Bill 4758 defines about the vape selling regulations and criminal red-line.

If a person markets, advertise sells or causes for sale vaping product and the packaging of that product that meets any of the following standards, that person commits a Class B misdemeanor that can result in civil and criminal penalties:

  1. Depicts a cartoon-like fictional character imitating a character whose primary purpose is to entertain minors;
  2. Imitate the trademark or product image of products whose main market is minors;
  3. Includes symbols used primarily to market products to minors;
  4. Includes images of celebrities;
  5. Include food-like images, including candy or juice.

Violation of these provisions may result in a Class B misdemeanor. The punishment includes up to 180 days in jail, a fine of up to $2,000, or both. The vape retailers may also face civil penalties of up to $3,000 and have their licenses suspension or revocation for repeat violations.

This requires many things to do from many aspects. First of all, vape terminal retailers cannot sell any vaping devices to minors. Secondly, vape manufacturers should not use packaging that would target underage smokers. Thirdly, vape flavors should reduce candies, fruits and other flavors that attract minors. Finally, marketing and advertising must not attract minors.
